Terms and Conditions of Physiotutors In-Person Courses

Article 1: Definitions

In these general terms and conditions, the following terms are defined as:

Course: A course organized by Physiotutors, including multi-day events or congresses, from start to finish.

Participant: The individual who registers or has registered for a course with Physiotutors.

 

Article 2: Registration

A participant can register for one or more courses.

Registration occurs by submitting a fully completed registration form.

Participants have a 14-day cooling-off period, regardless of whether the participant or their employer pays for the course. If the employer enters into the agreement in a business context, the cooling-off period does not apply.

Registration becomes final once Physiotutors has received the fully completed form and the cooling-off period in Article 2.3 has passed.

Registration via form or website implies agreement with the general, payment, and cancellation terms.

 

Article 3: Formation of the Agreement

Upon final registration (Article 2.4), Physiotutors confirms the conditional formation of an agreement. Course delivery depends on a sufficient number of registrations and speaker availability at the course location.

The minimum number of participants per course is fifteen, unless otherwise decided by Physiotutors. The maximum number of participants is determined per course.

The agreement is definitively established once Physiotutors has sent a confirmation of placement to the participant.

 

Article 4: Financial Obligations / Payment

Upon agreement between Physiotutors and the participant, the participant is obligated to pay the full course fee, citing the invoice number.

Course prices are determined annually and listed on the Physiotutors website.

Physiotutors does not offer payment in installments.

The participant remains liable for payment even if another party (e.g., employer) reimburses the course fee.

If the invoice is not paid on the agreed date, the participant is in default without further notice.

In case of default:

  • The full amount is due if payment is not received within 30 days before the course start.
  • Physiotutors may outsource the claim. All legal and extrajudicial costs are borne by the participant, according to the Voorwerk II report recommendations.
  • Access to the course may be denied if payment is overdue, without releasing the participant from payment obligations.

 

 

Article 5: Cancellation

Physiotutors reserves the right to cancel a course in case of insufficient registrations or unforeseen circumstances. Any paid fees will be refunded without interest.

If cancellation is due to the speaker’s illness or death, Physiotutors will propose an alternative date. No refund will be issued in such cases.

Physiotutors is not liable for any financial damage resulting from course cancellation, regardless of the reason.

 

Article 6: Early Termination / Financial Obligations

Physiotutors reserves the right to terminate the agreement if a participant disrupts the course or damages Physiotutors’ interests. Financial obligations remain unchanged.

If the participant ends participation early, no refund is given. Full payment remains due.

 

Article 7: Payment and Cancellation Terms

The invoice is sent after registration and serves as confirmation of participation. It must be paid within 14 days of the invoice date.

If cancelled after the invoice is sent, the participant owes 10% of the course fee as administrative costs.

Cancellation within six weeks of the course: 50% of the fee is due, unless the participant provides a replacement.

Cancellation within two weeks: no refund.

If payment is not made in time, a debt collection agency will be engaged after three months.

 

Article 8: Absence

Absence from course days does not entitle the participant to a partial or full refund.

Missed course days may be made up in a future course, subject to Physiotutors’ approval.

 

Article 9: Course and Study Information

Physiotutors reserves the right to make changes to its course offerings.

Before the course starts, participants receive practical information about the course proceedings.

 

Article 10: Accreditation

Accreditation will be requested for most courses. This is stated on the relevant course page.

It is the participant’s responsibility to verify the accreditation status.

 

Article 11: Usage Rights

Course materials provided by Physiotutors may not be copied or used outside the context of the course.

Physiotutors retains ownership of the course content. Participants receive only usage rights.

 

Article 12: Liability

Except in cases of intent or gross negligence, Physiotutors excludes all liability for damages, except where legally mandated.

If damage results from Physiotutors’ negligence, liability is limited to the course fee amount.

 

Article 13: Confidentiality

Participants must treat any personal information entrusted to them during the course confidentially.

 

Article 14: Complaints Procedure

Complaints can be submitted in writing and will be responded to within 14 days.

Physiotutors is affiliated with “De Geschillencommissie.” The committee’s decision is binding.

 

Article 15: Applicable Law

Only Dutch law applies to agreements with Physiotutors.

 

Article 16: Competent Court

Disputes will be submitted to the competent court, unless the subdistrict court has exclusive jurisdiction.

 

Article 17: Changes to Terms

Physiotutors reserves the right to amend these terms and conditions.
